Major J. (John) Toomy, d. Jul. 30, 1811. In 1801 John Toomy was one of five Toomey men who signed the Petition for the Creation of Roane County. In 1807 he received a grant for Lot No. 4 by right of occupancy in Sevier County, the only lot carved out of McMahan's original gift of 25 acres for the establishment of a town to the Commissioners of the Town of Sevierville. (Grant 1265 and "The Sevierville Story 1795-1995" by Beulah D. Linn, pp. 7-8.) In 1808 he was commissioned as 1st Major, 11th Regiment of the Tennessee Militia. ("Records of Commissions and Officers in the Tennessee Militia 1796-1811" compiled by Mrs. John Trotwood Moore.) The lawsuit of John Toomey v. William Porter, begun in 1807 over a dispute of ownership of this Lot No. 4, and reaching the Tennessee Supreme Court in 1815, mentions that between 1810 and 1812 during a lengthy continuance, that John Toomey died.
